Please read these Terms of Service carefully before using PODTrackerPRO. By accessing or using our service, you agree to be bound by these terms.

Acceptance of Terms

By creating an account and using PODTrackerPRO, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.

Eligibility

You must be at least 18 years old and able to form a binding contract to use PODTrackerPRO. This service is not directed at, and we do not knowingly collect information from, children under 13.

Description of Service

PODTrackerPRO is a software-as-a-service platform designed to help print-on-demand sellers track designs, monitor sales, and manage inventory across multiple selling platforms. We offer Free, Starter, and Business subscription tiers with varying features.

Account Registration

You must create an account to use PODTrackerPRO. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

Subscription and Billing

Free plan users have access to limited features at no charge.
Paid subscriptions (Starter and Business) are billed monthly.
Payments are processed securely through Stripe.
You may cancel your subscription at any time; access continues until the end of the billing period.
All fees are non-refundable except where required by applicable law. We do not provide partial or prorated refunds for unused time. If you believe you were charged in error, contact us within 14 days of the charge and we will review it.
We reserve the right to change pricing with 30 days notice to existing subscribers.

AI Features Are Not Professional Advice

PODTrackerPRO's DCEB scoring, AI Trademark Checker, keyword and trend research, design briefs, and SEO copy tools are generated using AI models (including Anthropic's Claude) and public/third-party market data. These outputs are informational and directional only. They are not legal advice, a trademark clearance opinion, financial advice, or a guarantee of sales, rankings, or outcomes. In particular, the AI Trademark Checker does not replace a professional trademark search or an attorney's opinion — you are solely responsible for verifying trademark, copyright, and other legal clearance for any design or listing before you publish or sell it. We are not liable for decisions made in reliance on AI-generated or third-party research output.

Acceptable Use

You agree not to misuse PODTrackerPRO. Prohibited activities include:

Attempting to access other users' accounts or data
Using the service for any unlawful purpose
Attempting to reverse engineer or copy the platform
Uploading malicious code or content

Your Data

You retain ownership of all data you enter into PODTrackerPRO. We do not claim ownership of your business data. You can export or delete your data at any time. We may anonymize and aggregate usage data to improve our service. Some of the data you enter is sent to third-party AI providers to generate features you request — see our Privacy Policy for details.

Limitation of Liability

PODTrackerPRO is provided "as is." We make no warranties about the accuracy, reliability, or suitability of the service for your particular needs. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service.

Indemnification

You agree to indemnify and hold PODTrackerPRO, its founder, and affiliates harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, the data you enter, your violation of these Terms, or your infringement of any third party's intellectual property or other rights (including designs or listings you create using tools or output from the service).

Termination

We reserve the right to suspend or terminate accounts that violate these Terms of Service. You may terminate your account at any time by contacting us or through your account settings.

Governing Law, Venue & Dispute Resolution

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the service shall be resolved by binding individual arbitration administered under the commercial arbitration rules of the American Arbitration Association (AAA), rather than in court, except that either party may bring an individual claim in small claims court. You and PODTrackerPRO each waive the right to a jury trial and to participate in a class action or class arbitration. Arbitration will take place in Georgia, USA, or another mutually agreed location, and may be conducted remotely where permitted by the arbitration provider's rules.

Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes via email or a prominent notice on our website. Continued use of the service after changes constitutes acceptance of the new terms.
